Article 1 (Purpose)
These Terms of Service ("Terms") govern the relationship between Trexone Co., Ltd. (operating as PTO China) and members who use the purchasing agent and shipping agent services provided through ptochina.com ("the Site"). By registering as a member or using any service on the Site, you agree to be bound by these Terms.
Article 2 (Definitions)
- "Service" means the purchasing agent, shipping agent, and related services provided by PTO China through the Site.
- "Member" means any individual or entity who has registered an account on the Site.
- "Order" means a request submitted by a Member for PTO China to purchase goods from Chinese sellers on the Member's behalf.
- "Application" means a request submitted by a Member for PTO China to receive and forward packages to Korea on the Member's behalf.
- "Commission" means the service fee charged by PTO China, calculated as a percentage of the product purchase price.
Article 3 (Membership)
Membership is granted upon successful completion of the registration process, including agreement to these Terms and the Privacy Policy. Members must provide accurate and complete information during registration.
Members are responsible for maintaining the confidentiality of their account credentials and for all activity that occurs under their account. Members must notify PTO China immediately of any unauthorized use of their account.
PTO China reserves the right to suspend or terminate membership for violations of these Terms, fraudulent activity, or failure to comply with applicable laws.
Article 4 (Services)
Purchasing Agent: PTO China will purchase goods from Chinese sellers as instructed by the Member. The Member is responsible for providing accurate product information. PTO China does not guarantee the quality, authenticity, or condition of goods purchased from third-party sellers.
Shipping Agent: PTO China will receive packages at its China-side warehouse and forward them to the Member's registered Korean address. The Member is responsible for ensuring that items shipped are not prohibited or restricted under Korean import regulations.
Additional Services: Optional services such as product photography, repackaging, and storage are available at additional cost as described in the Guidelines section of the Site.
Article 5 (Fees & Payment)
A flat commission of 5% of the product purchase amount applies to all customers, with no tiers. All fees are stated in Korean Won (KRW) unless otherwise specified.
Shipping costs, customs duties, insurance, and any applicable taxes are charged separately at cost and are not included in the commission rate.
All fees must be paid in full before goods are dispatched from the China warehouse to Korea. PTO China reserves the right to hold goods until payment is received.
Fee schedules may be updated with 30 days' advance notice to existing members via email and site notice.
Article 6 (Member Obligations)
Members agree not to use the Service to import goods that are prohibited or restricted under Korean law, including but not limited to counterfeit goods, controlled substances, weapons, or items that fail to meet Korean safety standards.
Members must obtain and maintain a valid Personal Customs Clearance Code (개인통관고유부호) and provide it to PTO China for all personal import shipments.
Members must provide accurate product descriptions and declared values. Providing false information to customs authorities is a criminal offence.
Article 7 (Limitation of Liability)
PTO China's liability is limited to direct damages arising from gross negligence or willful misconduct on the part of PTO China. PTO China is not liable for:
- Loss or damage caused by third-party carriers or customs authorities
- Delays caused by force majeure events (natural disasters, strikes, government actions, pandemics)
- The quality, authenticity, or fitness of goods purchased from Chinese sellers
- Customs duties, taxes, or fines assessed by Korean Customs
- Loss of profit, indirect, or consequential damages of any kind
Article 8 (Amendments)
PTO China may amend these Terms at any time. For material changes, existing members will be notified via email and site notice at least 7 days in advance of the effective date. Continued use of the Service after the effective date constitutes acceptance of the amended Terms.
Article 9 (Governing Law & Disputes)
These Terms are governed by and construed in accordance with the laws of the Republic of Korea. Any disputes arising from these Terms or use of the Service shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to the Seoul Central District Court as the court of first instance.
